Am 21. August 2020 hat die Welt Anti-Doping Agentur (WADA) die englische Fassung des Nationalen Anti-Doping Codes 2021 (NADC21) der Nationalen Anti Doping Agentur (NADA) offiziell anerkannt. Die NADA setzt damit die Vorgaben des revidierten Welt Anti-Doping Codes 2021 (WADC2021) im nationalen Regelwerk vorschriftsmäßig um und wird deshalb seitens der WADA für "compliant" erklärt.
Inhaltlich ergeben sich eine Vielzahl von Neuerungen. Ein weiterer Dopingtatbestand wird eingeführt. Alle Handlungen, die darauf abzielen, eine Person einzuschüchtern, zu bedrohen und davon abzuhalten, Verstöße gegen Anti-Doping-Bestimmungen an zuständige Organisationen zu melden, sind als Verstoß gegen Anti-Doping-Bestimmungen sanktionierbar.
Zudem wird die Verbotsliste der WADA zukünftig eine Substanzklasse "Suchtmittel" (u.a. Betäubungs- und Rauschmittel) enthalten. Mit der neuen Kategorisierung "Freizeitsportler*in" sollen zuständige Anti-Doping-Organisation Athleten*innen "unterhalb" des Spitzensports berücksichtigen können. Der Begriff "Schutzwürdige Personen" wird eingeführt. Darunter fallen alle Athleten*innen unter 18 Jahren, mit Ausnahme der 16- und 17-jährigen Elitesportler*innen, und alle Behindertensportler*innen, die nach geltendem nationalen Recht nicht (voll) geschäftsfähig sind.
Zentrale Neuerung des NADC21 ist die Überarbeitung des Ergebnismanagement- und Disziplinarverfahrens auf der Grundlage des neu eingeführten Standards für Ergebnismanagement- und Disziplinarverfahren. Basierend auf einer internationalen Harmonisierung der Verfahrensabläufe von Disziplinarverfahren werden auch die Prozessabläufe nationaler Sanktionsverfahren, zum Beispiel vor dem Deutschen Sportschiedsgericht, überarbeitet und angepasst.
Schließlich wird die Bedeutung der Präventionsarbeit hervorgehoben. Ein eigener Standard für Dopingprävention trägt maßgeblich zur weltweiten Verbesserung der Informations- und Aufklärungsarbeit bei. Ein wertebasierter Präventionsansatz wird Grundlage der zukünftigen Arbeit in diesem Bereich.
In der Compliance-Erklärung fordert die WADA dazu auf, dass alle nationalen Sportfachverbände und nationalen Stakeholder den NADC21 anerkennen und das Regelwerk der NADA entsprechend umsetzen. Zu diesem Zweck wird die NADA die deutsche Fassung des NADC21 für die nationalen Sportfachverbände im Herbst 2020 zur Verfügung stellen. Darüber hinaus wird die NADA einen Muster-Anti-Doping-Code als Umsetzungshilfe für den NADC21 erstellen lassen.
WADC2021 und NADC21 erhalten am 01.01.2021 Gültigkeit und lösen die bisherigen Regelungen aus dem Jahr 2015 ab.

National Anti-Doping Code 2021 recognised by WADA
On 21 August 2020, the World Anti-Doping Agency (WADA) officially recognised the English version of the National Anti-Doping Code 2021 (NADC21) of the National Anti Doping Agency of Germany (NADA Germany). NADA Germany thus correctly implements the requirements of the revised World Anti-Doping Code 2021 (WADC2021) in the national rules and regulations and is therefore declared "compliant" by WADA.
There are a number of changes in terms of content. A further doping offence is introduced. All actions aimed at intimidating, threatening or preventing a person from reporting anti-doping rule violations to responsible organisations are sanctionable as anti-doping rule violations.
In addition, WADA's Prohibited List will in the future contain a substance class "Substance of Abuse" (including narcotics and narcotic drugs). With the new categorisation "Recreational Athletes", anti-doping organisations will be able to consider athletes "below" the level of top-level sport. The term "Protected Person" is introduced. This includes all athletes under the age of 18, with the exception of elite athletes aged 16 and 17, and all disabled athletes who do not have (full) legal capacity under applicable national legislation.
The central innovation of NADC21 is the revision of the results management and disciplinary proceedings on the basis of the newly introduced Standard for Results Management and Disciplinary Proceedings. Based on an international harmonisation of the procedural sequences of disciplinary proceedings, the procedural sequences of national sanction proceedings, e.g. before the German Court of Arbitration for Sport, are also revised and adapted.
Finally, the importance of prevention work is emphasised. A separate standard for doping prevention contributes significantly to the worldwide improvement of information and education work. A value-based prevention approach will form the basis for future work in this area.
In the Compliance Declaration, WADA calls for all national sports federations and national stakeholders to recognise NADC21 and implement the rules accordingly. For this purpose, NADA Germany will make the German version of NADC21 available to the national sports federations in autumn 2020. In addition, NADA Germany will have a model anti-doping code drawn up as an implementation aid for NADC21.
WADC2021 and NADC21 will become valid on 01.01.2021 and replace the previous regulations from 2015.
