Die Nationale Anti Doping Agentur (NADA) blickte bei ihrer Jahres-Pressekonferenz am Mittwoch, die aufgrund der COVID-19-Pandemie erstmalig als Web-Seminar stattfand, auf die Anti-Doping-Arbeit 2019 zurück und gab einen Überblick über die aktuellen Herausforderungen für das Dopingkontrollsystem.

"Die Vorbereitung auf die Olympischen und Paralympischen Spiele in Tokio waren ein Schwerpunkt im Jahr 2019. Die NADA hatte bereits begonnen, die deutschen Sportlerinnen und Sportler als auch ihr Umfeld präventiv zu schulen, die Unterzeichnung der Ehrenerklärung aller beteilig­ten Personen zu organisieren und im Rahmen des Vor-Olympia-Testprogram­mes verstärkt zu kontrollieren. Diese Vorbereitungsmaßnahmen werden aufgrund der Verschiebung nun erneut für die Spiele 2021 aufgenommen werden", sagte Dr. Andrea Gotzmann, Vorstandsvorsitzende der NADA.

"Die "Operation Aderlass" beschäftigt die NADA seit Februar 2019. Die Erkenntnisse flossen sowohl in das Doping-Kontroll-System als auch in die präventive Arbeit der NADA ein", sagte Gotzmann.

Die NADA hatte unmittelbar nach Ausstrahlung der ARD-Dokumentation "Die Gier nach Gold - Der Weg in die Doping­falle" im Januar 2019 Strafanzeige gegen Unbekannt bei der zuständigen Staatsan­waltschaft gestellt. Die NADA unterstützte die anschlie­ßenden Ermittlungen in der "Operation Aderlass" und ging allen Hinweisen aus den Untersuchungsergebnissen nach, die auf Verstöße auf sportrechtlicher Ebene hindeuteten. Die NADA-Ermitt­lungen sowie ein Whistleblower-Hinweis führten zur Einleitung eines Verfahrens gegen einen ehemaligen deutschen Spitzensportler vor dem Deutschen Sportschiedsgericht im Mai 2019. Das Verfahren ist anhängig. Weitere Verfahren werden durch die Kolleginnen und Kollegen aus der Schweiz und Österreich im Rahmen der "Operation Aderlass" geführt, mit denen die NADA weiterhin in einem engen Austausch steht.

"Die bislang aufgedeckten kriminellen Strukturen haben gezeigt, dass Deutschland mit dem Anti-Doping-Gesetz den richtigen Weg eingeschlagen hat. Die NADA wird daher weiterhin eng mit den Schwerpunktstaatsanwaltschaften zusammenarbeiten", sagte Dr. Lars Mortsiefer, Vorstandsmitglied und Chefjustitiar der NADA.

Im Rahmen der Weltkonferenz gegen Doping im Sport im November 2019 in Kattowitz (Polen) verabschiedete die Welt Anti-Doping Agentur (WADA) den Welt Anti-Doping Code 2021. "Nach einem zweijährigen Überarbeitungs- und Konsultationsprozess, federführend organisiert durch die WADA, sind nun die Internationalen Sportfachverbände und die Nationalen Anti-Doping-Organisationen aufgefordert, den Welt Anti-Doping Code in die nationalen Anti-Doping-Regelwerke zu integrieren. In Deutschland übernimmt die NADA die Umsetzung in den Nationalen Anti-Doping Code", erläuterte Mortsiefer.

Zur Verbesserung der internationalen Anti-Doping-Arbeit hat sich die NADA 2019, zusammen mit weiteren 19 führenden NADOs, auch mit dem designierten WADA-Präsidenten Witold Banka getroffen und entsprechende Forderungen vorgebracht. "Verbesserungen des Systems sind vor allem mit Blick auf kommende, internationale Sportgroßereignisse essenziell", so Gotzmann: "Der internationale Austausch ist auch 2020 insbesondere mit Blick auf die Auswirkungen der COVID-19-Pandemie fortgeführt worden." Die NADA hatte Mitte März die Durchführung klassischer Urin- und Blutkontrollen vorübergehend ausgesetzt und diese Mitte Mai unter Beachtung entsprechender Sicherheitsvorkehrung zur Infektionsverhütung mit SARS-CoV-2 wiederaufgenommen. Erste Wettkampfkontrollen wurden in der Bundesliga und 2. Bundesliga im Fußball durchgeführt. 

Die NADA hat zur Unterstützung der sauberen Sportlerinnen und Sportler in der Zwischenzeit ein weiteres Pilotprojekt zur Anwendung des Dried Blood Spot (DBS)-Tests im Rahmen der Kontrollmaßnahmen gestartet. Weiterhin hat die NADA ihre Maßnahmen im Bereich der Intelligence & Investigations-Arbeit verstärkt und nutzt derzeit alle Möglichkeiten der Analytik, um den Zeitraum ohne herkömmliche Kontrollen genau zu untersuchen.

"Für die Erfüllung aller in der Stiftungsverfassung der NADA festge­schriebenen Aufgaben ist die nachhalti­ge finanzielle Sicherung extrem wichtig. Der Deutsche Bundestag hat die zentrale Rolle der NADA in der Anti-Doping-Arbeit anerkannt und stellt sicher, dass die Stiftung durch die institutionelle Förderung mittel- und langfristig abgesichert wird. Seit Januar 2020 ist die Finanzierung der NADA als Stakeholder-Modell dadurch in großen Teilen abgelöst worden", erläuterte Gotzmann.

NADA Germany: Annual Press Conference

The National Anti Doping Agency of Germany (NADA) took a look back on the year 2019 and its anti-doping work and gave an overview of the current challenges for its testing programme during its annual press conference on Wednesday, which was held as a web seminar due to the COVID 19 pandemic for the first time.

"Preparing for the Olympic and Paralympic Games in Tokyo was a focus in 2019. NADA had already started to provide educational trainings for German athletes and their support personnel, to organize the signing of the declaration of honor by all those involved and in to test in the framework of the pre-Olympic testing programme. Due to the postponement, these preparatory measures will now be resumed for the 2021 Games", said Dr. Andrea Gotzmann, Chairperson of NADA Germany's Executive Board.

"The "Operation Aderlass" has been a concern of NADA Germany since February 2019. The findings flowed into both the testing programme and NADA Germany's educational work", said Gotzmann. Immediately after the ARD documentary "The Greed for Gold - The road to the doping trap" that was broadcast in January 2019, NADA Germany filed a criminal complaint against unknown with the responsible public prosecutor. NADA Germany supported the subsequent investigations in the "Operation Aderlass" and followed up on all indications from the investigation results, which indicated violations against anti-doping rules. NADA Germany's investigation and a whistleblower tip led to the initiation of proceedings against a former top German athlete before the German Sports Arbitration Court in May 2019. The proceeding is pending. Colleagues from Switzerland and Austria are conducting further procedures as part of the "Operation Aderlass", with which NADA Germany is still in close contact.

"The criminal structures uncovered so far have shown that Germany has taken the right path with the anti-doping law. NADA Germany will therefore continue to work closely with the key public prosecutors", said Dr. Lars Mortsiefer, Member of NADA's Executive Board and Chief Legal Officer of NADA Germany.

As part of the World Conference Against Doping in Sport in November 2019 in Katowice (Poland), the World Anti-Doping Agency (WADA) adopted the World Anti-Doping Code 2021. "After a two-year revision and consultation process, organized by WADA, now the International Sports Federations and the National Anti-Doping Organizations (NADOs) are asked to integrate the World Anti-Doping Code into the national anti-doping regulations. In Germany, NADA Germany is implementing the National Anti-Doping Code", Mortsiefer explained.

In order to improve the international anti-doping work, NADA Germany, together with another 19 leading NADOs, also met with the designated WADA President Witold Banka and made corresponding demands. "Improvements to the system are essential, especially with a view to upcoming major international sporting events", Gotzmann said: "The international exchange continued in 2020, especially with regard to the effects of the COVID 19 pandemic." In mid-March NADA Germany suspended urine and blood testing temporarily and resumed in mid-May with appropriate safety precautions for infection prevention with SARS-CoV-2. The first in-competition tests were carried out in soccer in the Bundesliga and 2nd Bundesliga.

In the meantime, NADA Germany has started another pilot project to support the clean athletes by using the Dried Blood Spot (DBS) test as part of the testing measures. Furthermore, NADA Germany has intensified its measures in the area of intelligence & investigations and is currently using all analytical options to examine the period in detail without conventional tests.

"Sustainable financial security is extremely important for the fulfillment of all the tasks set out in the foundation constitution of NADA Germany. The German Bundestag has recognized NADA Germany's central role in anti-doping work and ensures that the foundation is secured in the medium and long term through institutional funding. This has largely replaced NADA Germany's financing as a stakeholder model since January 2020", Gotzmann explained.
