Besides supporting sports federations with implementing anti-doping rules, the Legal Department is also responsible for the initial verification of positive doping tests and whereabouts filing failures. Depending on whether the result management and disciplinary procedures of the relevant sports federation has been transferred to NADA, the potential anti-doping rule violation will be processed by NADA's staff or the respective sports federation. NADA is committed to ensuring that the disciplinary proceedings are carried out by an independent institution. Therefore, it is essential that NADA not only carries out all doping controls, but also all disciplinary proceedings of the German sports federations. Then the German Sports Arbitration Court would be the responsible independent disciplinary body in all anti-doping rule violations in Germany. Only then an independent, fair and consistent proceeding can be ensured that ends in a harmonised sports law.
